39. Qualifications of the Safety officer.- (1) No person shall be eligible for appointment as a Safety Officer relating to factory or building or other construction work unless he or she,– (i) possesses a recognised degree in any branch of engineering or technology and has had practical experience of working in a factory or in a building or other construction work in a supervisory capacity for a period of not less than 2 years; or (ii) possesses a recognized degree in physics or chemistry and has had practical experience in a supervisory capacity for a period of not less than 5 years; or (iii) possesses a diploma from a recognised university in any branch of engineering or technology and has had practical experience of working in a factory or in a building or other construction work in a supervisory capacity for a period of not less than 5 years; and (iv) possesses a degree or diploma in industrial safety from a recognised institute. (2) Notwithstanding anything contained in sub-rule (1), any person who, – (i) possesses a degree or diploma in engineering or technology and has had experience of not less than 5 years in a department of the Central or State Government which deals with the administration of Factory or Building and other Construction Works; or (ii) possesses a degree or diploma in engineering or technology and has had experience of not less than 5 years, full time, on training, education, consultancy or research in the field of accident prevention in industry or in any institution; shall also be eligible for appointment as a Safety Officer.

(2) Notwithstanding anything contained in sub-rule (1), any person who, –
